This is committed when a person without lawful authority destroys or damages or intends to destroy or damage or is reckless as to whether property belonging to another is destroyed or damaged and the destruction or damage is caused by fire.

This is an indictable only offence punishable by a maximum sentence of life imprisonment.

It can only be tried in the Crown Court.

Anyone convicted of Arson with intent to endanger life or being reckless as to whether life is endangered can expect to be sentenced to a lengthy term of imprisonment.

 

Defence

If a fire was started completely accidentally then the accused would have a defence to this charge because the prosecution have to prove an intention and or a recklessness.
