Kidnap or Abduction

Is the taking away of someone by force and against their will. Abduction can often occur in situations where estranged parents take their  young children away from the other parent. Alternatively it can occur in the classic case where there is a kidnapping and then a ransom requested.

False Imprisonment

Is where a person is unlawfully detained against their will. This could occur if a person believes someone has committed an offence and then detains them for the arrival of the police.

Both these offences can be punished by way of fine and or imprisonment. There are guidelines that the court will follow when sentencing. The sentence will be determined by the seriousness of the offence.
